Terms of Use

These Terms of Use govern your use of Tubindex, an online AI-powered video summarisation service operated by ATOM47 EOOD.

1. Purpose

These Terms of Use ("Terms") govern the conditions under which ATOM47 EOOD ("Tubindex", "we") provides the Tubindex service, accessible at tubindex.com (the "Service").

The Service notably provides:

  • AI-generated summaries of YouTube videos;
  • automated video transcript extraction;
  • YouTube channel subscriptions and a personalised feed;
  • personal notes and hashtag-based categorisation;
  • text search in your notes;
  • multilingual summary translations (French and English).

By creating an account, you accept these Terms without reservation.

2. Definitions

  • User: any natural or legal person who has created an account on tubindex.com.
  • User Content: notes, hashtags, and personal settings you create within the Service.
  • Generated Content: summaries and translations produced by the Service for your account.
  • Third-Party Content: YouTube videos, metadata, and transcripts.

3. Account creation

3.1 Eligibility

To create an account, you must:

  • provide a valid email address;
  • be at least 16 years old;
  • open the sign-in link sent to that address.

3.2 Email link sign-in

Sign-up and sign-in use a single-use link sent to your email address. This link is valid for 15 minutes and works only once. You do not choose a password or a username. Your username is assigned automatically from your email address.

If you open the link on a different device from the one that requested it, that device shows a 6-digit code. Enter this code on the device that made the request. Tubindex never asks you for this code or this link by phone, instant messaging or email: never share them with anyone.

Passwords created before the email link sign-in was introduced are no longer used. They will be deleted from our servers after the transition period.

3.3 Account security

Access to the mailbox linked to your account gives access to your account. You must therefore keep control of this mailbox. You are solely responsible for all activity carried out from your account. You agree to notify us without delay at support@tubindex.com of any unauthorised use.

If you lose access to this mailbox, contact support@tubindex.com to recover your account.

To protect your account:

  • you can sign out all your other devices from the /settings page;
  • we send an email to your account's email address when a sign-in is confirmed with a code;
  • when the account email changes, your previous address receives a notice with a cancellation link valid for 7 days.

3.4 Account uniqueness

Each account is strictly personal. Account sharing is not allowed.

4. Acceptable use

You agree to use the Service in good faith and in compliance with applicable law and these Terms. The following are prohibited:

  • scraping, automated harvesting, or bulk extraction of Service content using bots, scripts, or unauthorised tools;
  • reselling, redistributing, or commercially making available the Service or Generated Content to third parties;
  • circumventing security mechanisms, rate-limiting, or access controls;
  • using the Service to process unlawful, defamatory content or content infringing third-party rights;
  • any attempt to reverse-engineer the code or models used.

5. User Content

You retain all intellectual property rights in your User Content (notes, custom hashtags, settings).

You grant us a non-exclusive licence, strictly limited to the technical operation of the Service (storage, display to you, backup, processing by our sub-processors listed in the Privacy Policy).

This licence terminates upon deletion of your account, subject to statutory retention periods.

6. Third-Party Content — YouTube

The Service processes videos hosted on YouTube. You acknowledge that:

  • videos, titles, thumbnails, and transcripts remain the property of their respective rights holders;
  • your use of this content is subject to YouTube's terms of service (youtube.com/t/terms);
  • we neither host nor redistribute videos: we produce summaries from their transcripts.

7. Service availability

We make reasonable efforts to keep the Service available 24/7. However, the standard offer is not covered by any contractual service-level agreement (SLA).

Interruptions may occur for maintenance, updates, or due to failures at our technical sub-processors. We strive to report and resolve them promptly.

8. Suspension and termination

8.1 Termination by you

You may delete your account at any time from the /settings page. Deletion triggers the erasure of your data as described in the Privacy Policy (30-day soft-delete window followed by permanent erasure).

8.2 Suspension by us

We may suspend or terminate your account, after email notice and a reasonable cure period, in the event of:

  • serious or repeated breach of these Terms;
  • persistent payment default on paid accounts;
  • fraudulent or abusive use (quota circumvention, automated scripts).

In urgent cases (security risk, legal action), suspension may be immediate.

9. Liability

The Service is provided "as is". AI-generated summaries may contain inaccuracies: you agree to verify any critical information against the source.

Our total liability to you, regardless of cause, is capped at the amount actually paid over the three (3) months preceding the triggering event. This cap does not apply where it would contradict a mandatory provision of applicable consumer law.

We are not liable for indirect damages (loss of data, loss of opportunity, commercial prejudice).

10. Tubindex intellectual property

The Tubindex brand, logo, user interface, source code, databases, and documentation are protected by copyright and trade mark law. No reproduction, adaptation, or substantial extraction is permitted without our prior written consent.

11. Changes to the Terms

We may amend these Terms at any time. Any material change will be notified to you by email at least thirty (30) days before it takes effect. Past this period and absent termination on your part, the new Terms will apply.

12. Governing law and jurisdiction

These Terms are governed by Bulgarian law, subject to the mandatory consumer protection provisions of your country of habitual residence (Rome I Regulation, Brussels I bis Regulation).

For consumer users, the courts of the user's country of residence have jurisdiction. For business users, the courts of Sofia (Bulgaria) have exclusive jurisdiction.
